DMCA Policy

1. Introduction

BD Factory respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our service.

3. Filing a DMCA Takedown Notice

If you believe that content on BD Factory infringes your copyright, please send a written notification containing the following information:

  1. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved
  2. Identification of the infringing material and information reasonably sufficient to permit us to locate it (e.g., URL or description)
  3. Your contact information: name, address, telephone number, and email address
  4. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner
  6. Your physical or electronic signature

4. Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification containing:

  1. Identification of the material that was removed and its location before removal
  2. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  3. Your name, address, telephone number, and email address
  4. A statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the complainant
  5. Your physical or electronic signature

5. Repeat Infringer Policy

BD Factory maintains a policy of terminating, in appropriate circumstances, accounts of users who are deemed to be repeat infringers. We may also limit access to our service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6. Good Faith

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.
